Fridge not working properly in apartment Va?

I have had this problem since i moved in the freezer keeps freezing up. The ice then blocks the drain hole for the defrost and eventually starts dripping into my fridge. I had a maintenance guy come out and look at it all he did was take the ice out and clean out the drain. He said it would just keep doing it and it should be replaced. I threw out 50-60 bucks of food not worried about that. The apartment manager said that she wanted the other guy to look at it. It is monday now he said he fixed it, and i asked what he did he said he did the same exact thing that the other guy did. I said all that ice built up from friday to monday. It will just do it again he said he fixed it and that he would be back in the afternoon to look at it. If it is not working correctly don't they have to replace it. Also if they don't can i buy my own and deduct it from rent. Last time it froze the fridge got up to 70 deg. i told him i don't want to keep buying food just to throw it away when there not going to reimburse me for it.
